Terms of Use

1. SCOPE OF THESE TERMS

These Terms apply to your use of https://www.mystopiafoundation.org and any related websites, applications, forms, or services we operate (collectively, the "Site"), including registrations, applications, payments, submissions, and communications facilitated through the Site.

These Terms do not replace or supersede other agreements, policies, or documents that may apply to participation in Mystopia community activities, including but not limited to event participation waivers, camp participation agreements, and the Mystopia Foundation Code of Conduct. Participation in Mystopia-organized events, gatherings, or activities - whether on- or off-playa - is governed by those separate documents, which are incorporated by reference where applicable.

2. ACCEPTANCE OF TERMS

By accessing or using the Site, you represent that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must discontinue use of the Site immediately. We may update these Terms from time to time. Changes become effective when posted, and continued use of the Site constitutes acceptance of the revised Terms.

3. ELIGIBILITY AND AGE REQUIREMENTS

The Site is intended for individuals who are at least 18 years of age. Minors may participate in Mystopia events or activities only where explicitly permitted and with appropriate parental or guardian consent, as governed by applicable event policies and waivers.

4. COMMUNITY STANDARDS AND CODE OF CONDUCT

Participation in Mystopia community spaces - online or offline - is subject to the Mystopia Foundation Code of Conduct, which is incorporated by reference. The Code of Conduct applies year-round and may govern conduct occurring outside Mystopia events where such conduct impacts community safety, trust, or participation. The Code applies to all Mystopia-organized activities, including but not limited to Burning Man participation, campouts, fundraisers, meetings, online collaboration spaces, and community communications.

Violations of the Code of Conduct may result in actions including removal from events or activities; suspension or termination of Site access; revocation of membership, participation, or leadership privileges; and referral to external authorities where required by law. Enforcement is handled by Mystopia Foundation leadership, Community Safety leads, and/or its Board using processes described in applicable conduct and safety documents. Enforcement may occur independently of Site access and may apply regardless of whether the conduct occurred on or off the Site.

5. INTELLECTUAL PROPERTY

Unless otherwise indicated, the Site and its content - including text, graphics, logos, software, and design - are owned by or licensed to Mystopia Foundation and are protected by applicable intellectual property laws. You may access and use the Site for personal, non-commercial purposes only, except as expressly authorized by Mystopia.

6. USER SUBMISSIONS AND CONTRIBUTIONS

6.1 Community Contributions

The Site may allow you to submit content such as comments, ideas, media, or other materials shared within community spaces ("Community Contributions"). You retain ownership of your Community Contributions. By posting them, you grant Mystopia a non-exclusive, royalty-free, worldwide license to host, display, and distribute the content solely for the purpose of operating and maintaining community spaces. Mystopia does not claim ownership of your creative work shared informally within the community.

6.2 Operational and Event Contributions

Content submitted for Mystopia operational needs - including but not limited to applications, event submissions, volunteer materials, documentation, media for promotion, or logistics coordination ("Operational Contributions") - may be used, adapted, archived, and shared by Mystopia as reasonably necessary to operate events and programs; coordinate volunteers and participants; promote Mystopia activities; and maintain institutional records.

By submitting Operational Contributions, contributors acknowledge that such work is intended to support Mystopia's ongoing operations and communal continuity. Unless otherwise agreed in writing in advance, Mystopia may retain, adapt, and continue use of these materials to operate events, support future community needs, and preserve institutional knowledge. This license does not transfer ownership of your underlying intellectual property.

7. PROHIBITED USES

You agree not to use the Site for unlawful or unauthorized purposes; attempt to interfere with Site security or functionality; misrepresent your identity or affiliation; or use automated systems to access or scrape the Site without permission. Commercial use of the Site is prohibited except for Mystopia Foundation-authorized fundraising, ticketed events, merchandise, or partnerships.

8. PAYMENTS AND THIRD-PARTY SERVICES

Payments made through the Site (including dues, donations, ticketing, storage fees, or other charges) may be processed by third-party providers. Mystopia does not store full payment credentials.

Participation in Mystopia events may additionally require execution of separate liability waivers, event-specific agreements, or camp participation agreements, which govern physical activities, travel, volunteering, and on-site conduct. Those documents apply in addition to these Terms.

9. DATA AND PRIVACY

Your use of the Site is subject to our Privacy Policy, available at https://mystopia.org/privacy-policy, which is incorporated by reference. The Site is not intended for the collection of sensitive regulated data such as medical records or financial account numbers beyond what is necessary to process payments or participation.

10. DISCLAIMERS

The Site is provided on an "AS IS" and "AS AVAILABLE" basis. Mystopia disclaims all warranties to the fullest extent permitted by law. Use of the Site is at your own risk.

11. LIMITATION OF LIABILITY

To the fullest extent permitted by law, Mystopia Foundation and its directors, officers, volunteers, and agents shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Site.

12. TERMINATION

We reserve the right to suspend or terminate your access to the Site at any time for violation of these Terms or applicable policies.

13. GOVERNING LAW

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles.

14. MISCELLANEOUS

If any provision of these Terms is held unenforceable, the remaining provisions will remain in effect. These Terms constitute the entire agreement regarding Site use.

15. HOW THESE DOCUMENTS FIT TOGETHER

These Terms of Use govern your interaction with Mystopia's digital infrastructure and online services. Participation in Mystopia events, volunteer roles, leadership positions, or community spaces is additionally governed by the Mystopia Foundation Code of Conduct and, where applicable, event-specific liability waivers and participation agreements. Together, these documents form the framework that supports a safe, inclusive, and functional community. If there is a conflict, the Code of Conduct and event-specific agreements control with respect to behavior, safety, and participation, while these Terms control Site access and digital use.
